1. Acceptance of Terms
The services that Child Action, Inc. (“Child Action”, “us”, “we”, “our”) provides to you are subject to the following Terms of Use (“TOU”). Child Action reserves the right to update the TOU at any time without notice. The most current version can be reviewed via the “Terms of Use” link at the bottom of our website.

2. Description of Services
Through its network of websites, Child Action provides access to various resources including tools, forms, documents, and training materials (“Services”). These include updates, enhancements, new features, and new web properties, all subject to the TOU.

3. Information and Agency Use Limitation
Unless otherwise specified, the Services are intended for informational and Agency use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any materials obtained from the Services.

4. Notice Specific to Software
Any software available for download through the Services (“Software”) is the copyrighted work of Child Action and/or its suppliers.

Use is governed by the accompanying End User License Agreement (“License Agreement”).

You may not install the Software without agreeing to the License Agreement.

Reproduction or redistribution of Software outside the License Agreement is prohibited and may result in civil or criminal penalties.

Software is warranted only as described in the License Agreement. All other warranties (express, implied, statutory) including merchantability and fitness for a particular purpose are disclaimed.

Tools and Utilities
Child Action may offer downloadable tools/utilities. No guarantees are made regarding the accuracy or results from such tools. Users must respect the intellectual property rights of others.

5. Restricted Rights (U.S. Government)
Software downloaded for or on behalf of the U.S. Government is provided with Restricted Rights in accordance with:

DFARS 252.227-7013(c)(1)(ii), or

48 CFR 52.227-19(c)(1) and (2)

6. Notice Specific to Documents
Permission to use downloadable documents (e.g., white papers, press releases, FAQs) is granted under the following conditions:

The copyright and permission notice is included.

Use is limited to informational and Agency use only.

No modifications are made.

No distribution outside the Agency without written consent.

Design elements, logos, and layouts of the Child Action website are protected by trade dress, trademark, and other laws and may not be copied or reused without permission.

7. Disclaimers
Child Action and its suppliers make no guarantees about the accuracy or suitability of the information provided. All documents and graphics are provided “as is” without any warranty.

Child Action is not liable for:

Indirect, special, or consequential damages

Loss of data, profits, or use

8. No Unlawful or Prohibited Use
You may not:

Use the Services for illegal or unauthorized purposes

Interfere with other users’ access

Attempt unauthorized access to systems or data

Harvest or extract data through unapproved means

9. User Submissions
You retain ownership of materials you submit (“Submissions”), but by submitting them, you grant Child Action a worldwide, royalty-free license to:

Use, reproduce, edit, display, distribute, and sublicense your Submissions

Use your name in connection with the Submission

No compensation is offered. Submissions may be removed at Child Action’s discretion.

Image Submissions
By uploading images, you confirm:

You own or have rights to the content and individuals depicted

You grant license rights as above

Termination of the license occurs when the image is fully removed from the Services

10. Links to Third-Party Sites
External links may appear on our site. Child Action:

Is not responsible for the content of linked sites

Does not endorse or guarantee those sites

Provides links for convenience only

11. Notices Regarding Software, Documents, and Services
Child Action and its suppliers are not liable for damages arising from:

Software use or failure

Inaccurate documents or outdated data

Delays, losses, or disruptions
